A member was sued for a repossession deficiency when her ex-husband turned in the BMW that she had co-signed for. Their divorce decree provided for the ex to be responsible for the car payments. Although the ex was named as a co-defendant, the plaintiff was never able to serve him with process. The potential liability to the member with attorney's fees was around $20,000. At the time of the sale of the repossessed vehicle, the bank provided our member with a letter stating that it would not go after her for the deficiency. Despite that "statement", the bank sued her and we defended the claims. The Judge refused to dismiss the case in preliminary hearings, but reserved the right to rule on the issue of the letter at trial. The opposing counsel would not accept our offer for our client to pay her $3,000 tax refund as a settlement. The best they would offer was $15,000. Our member elected to use her trial hours and we advised plaintiff's counsel that we were preparing for trial on 10/15. The plaintiff's attorney contacted us on 10/12 and advised they were dismissing the complaint. A member with a business plan contacted the Provider Firm because one of his clients was refusing to make payment per a signed contract. A Provider Attorney wrote a letter to the company and our member received payment in full in the amount of $750. |
